New 2025 Copyright Guidelines for Collective Management Organizations

The Intellectual Property Corporation of Malaysia (MyIPO) has issued the updated 2025 Guidelines of Copyright (Collective Management Organization) under the Copyright Act 1987. Effective from 16 January 2026, these guidelines aim to regulate and strengthen the operations, governance, and accountability of Collective Management Organizations (CMOs) in Malaysia.

Key highlights include:

Operational Structure & Licensing: CMOs must operate as companies limited by guarantee and may only manage rights on behalf of their members. Licensing schemes must be transparent, published publicly, and aligned with the Copyright Act.

Governance & Membership: Strict requirements are set for board composition, director qualifications, and membership agreements to ensure fair representation and transparency.

Financial Accountability: CMOs are required to maintain clear financial records, enforce capped administrative costs, and follow defined policies for royalty distribution.

Public Transparency: CMOs must publish key documents, including tariff rates and board information, and provide mechanisms for dispute resolution.

Dispute Management: Members and users have the right to escalate unresolved issues to the Copyright Tribunal.

These guidelines are part of Malaysia’s ongoing efforts to protect intellectual property rights while promoting fair use and transparency in copyright licensing and royalty management.
